Acceptale Use Policy

As a provider of web site hosting and other Internet-related services, NetRage Networks offers its customer (also known as "Subscribers") and their customers and users the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. NetRage Networks respects that the Internet provides a forum for free and open discussion and dissemination of information. However, when there are competing interests at issue, NetRage Networks reserves the right to take certain preventive or corrective actions. In order to protect these competing interests, NetRage Networks has developed an Acceptable Use Policy ("AUP"), which supplements and explains certain terms of each customer's respective service agreement, and is intended as a guide to the customer's rights and obligations when using NetRage Networks' services. This AUP will be revised from time to time. A customer's use of NetRage Networks' services after changes to the AUP are posted on NetRage Networks' web site, www.netrage.net, will constitute the customer's acceptance of any new or additional terms of the AUP resulting from those changes.

One important aspect of the Internet is that no one party owns or controls it. This fact accounts for much of the Internet's openness and value, but it also places a high premium on the judgment and responsibility of those who use it, both in the information they acquire and in the information they disseminate to others. When subscribers obtain information through they Internet, they must keep in mind that NetRage Networks cannot monitor, verify, warrant or vouch for the accuracy and quality of the information they acquire. For this reason, the subscriber must exercise his or her best judgment in relying on information obtained from the Internet, and also should be aware that some material posted to the Internet may be sexually explicit or otherwise offensive. Because NetRage Networks cannot monitor or censor the Internet, and will not attempt to do so, NetRage Networks cannot accept any responsibility for injury to its subscribers resulting from inaccurate, unsuitable, offensive or illegal Internet communications.

When subscribers disseminate information from the Internet, they must keep in mind that NetRage Networks does not review, edit, censor or take responsibility for any information its subscribers may create. When users place information on the Internet, they have the same liability as other authors for copyright infringement, defamation and other harmful speech. Also, because the information created is carried over NetRage Networks' network and may reach a large number of people, including both subscribers and non-subscribers of NetRage Networks, subscribers' postings to the Internet may affect other subscribers and may affect NetRage Networks' goodwill, business, reputation or operations. For these reasons, subscribers violate NetRage Networks policy and the Service Agreement when they, their customers, affiliates or subsidiaries engage in the following prohibited activities:

  1. Spamming: Sending unsolicited bulk and/or commercial information over the Internet. It is not only harmful because of its negative impact on consumer attitudes toward NetRage Networks, but also because it can overload NetRage Networks' network and disrupt service to NetRage Networks' subscribers. Also, maintaining an open SMTP relay is prohibited. When a complaint is received, NetRage Networks will investigate and shutdown the account that is SPAMing. A $250 charge for violating this policy will be charged to the person initiating the SPAM. Furthermore, NetRage Networks reserves the right to prosecute for this violation. A $1.00 charge will be assessed PER EMAIL sent should NetRage Networks choose to pursue and prosecute.

     

  2. Intellectual Property Violations: Engaging in any activity that infringes or misappropriates the intellectual property rights of others, including copyrights, trademarks, service marks, trade secrets, software piracy and patents held by individuals, corporations or other entities. Also, engaging in activity that violates privacy, publicity or other personal rights of others. NetRage Networks is required by law to remove or block access to customer content, upon receipt of a proper notice of copyright infringement. It is also NetRage Networks' policy to terminate the privileges of customers who commit repeat violations of copyright laws.

     

  3. Obscene Speech or Materials: Using NetRage Networks' network to advertise, transmit, store, post, display, or otherwise make available child pornography or obscene speech or material is prohibited. NetRage Networks is required by law to notify law enforcement agencies when it becomes aware of the presence of child pornography on or being transmitted through its network.

     

  4. Defamatory or Abusive Language: Using NetRage Networks' network as a means to transmit or post negative, defamatory, harassing, abusive or threatening language.

     

  5. Forging of Headers: Forging or misrepresenting message headers, whether in whole or in part, to mask the originator of the message.

     

  6. Illegal or Unauthorized Access to Other Computers or Networks: Accessing, illegally or without authorization, computers, accounts or networks belonging to another party, or attempting to penetrate security measures of another individual's system (often known as "hacking"). Also, any activity that may be used as a precursor to an attempted system penetration (i.e., port scan, stealth scan or other information-gathering activity).

     

  7. Distribution of Internet Viruses, Worms, Trojan Horses or Other Destructive Activities: Distributing information regarding the creation of and sending Internet viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial of service attacks. Also, activities that disrupt the use of or interfere with the ability of others to effectively use the network or any connected network, system, service or equipment.

     

  8. Facilitation a Violation of this AUP: Advertising, transmitting or otherwise making available any software, program, product or service that is designed to violate this AUP, which includes the facilitation of the means to spam, initiation of pinging, flooding, mailbombing, denial of service attacks and piracy of software.

     

  9. Export Control Violations: Exporting encryption software over the Internet or otherwise, to points outside the United States.

     

  10. Usenet Groups: NetRage Networks reserves the right not to accept postings from newsgroups where we have actual knowledge that the content of the newsgroup violates the AUP.

     

  11. Other Illegal Activities: Engaging in activities that are determined to be illegal, including, but not limited to, advertising, transmitting or otherwise making available ponzi schemes, pyramid schemes, fraudulently charging credit cards and pirating software.

     

  12. Other Activities: Engaging in activities, whether lawful or unlawful, that NetRage Networks determines to be harmful to its subscribers, operations, reputation, goodwill or customer relations.

As we have pointed out, the responsibility for avoiding harmful activities just described rests primarily with the subscriber. NetRage Networks will not, as an ordinary practice, monitor the communications of its subscribers to ensure that the comply with NetRage Networks' policy or applicable law. However, when NetRage Networks becomes aware of harmful activities, it may take any action to stop the harmful activity, including, but not limited to, removal of information, shutting down a web site, implementing screening software designed to block offending transmissions, denying access to the Internet, or any other action deemed appropriate by NetRage Networks.

NetRage Networks is also aware that many of its subscribers are themselves providers of Internet services, and that information reaching NetRage Networks' facilities from those subscribers may have originated from a customer of the subscriber or from another third party. NetRage Networks does not require its subscribers who offer Internet services to monitor or censor transmissions or web sites created by customers of its subscribers. NetRage Networks reserves the right to directly take action against a customer of its subscribers. Also, NetRage Networks may take action against the NetRage Networks' subscriber because of activities of a customer of the subscriber, even though the action may affect other customers of the subscriber. Similarly, NetRage Networks anticipates that subscribers who offer Internet services will cooperate with NetRage Networks in any corrective or preventive action that NetRage Networks deems necessary. Failure to cooperate with such corrective or preventive measures is a violation of NetRage Networks policy.

NetRage Networks will not intentionally monitor private electronic mail messages sent or receive by its subscribers, unless required to do so by law, governmental authority or when public safety is at stake. NetRage Networks may, however, monitor its service electronically to determine that its facilities are operating satisfactorily. Also, NetRage Networks may disclose information, including, but not limited to, information concerning a subscriber, a transmission made using our network, or a web site, in order to comply with a court order, subpoena, summons, discovery request, warrant, statute, regulation or governmental request. NetRage Networks assumes not obligation to inform the subscriber that subscriber information has been provided and, in some cases, may be prohibited by law from giving such notice. Finally, NetRage Networks may disclose subscriber information or information transmitted over its network where necessary to protect NetRage Networks and others from harm, or where such disclosure is necessary to the proper operation of the system. However, NetRage Networks will never sell information to other services or outside companies.

NetRage Networks expects that its subscribers who provide Internet services to others will comply fully with all applicable laws concerning the privacy of online communications. A subscriber's failure to comply with those laws will violate NetRage Networks policy. Finally, NetRage Networks wishes to emphasize that, in signing the Service Agreement, subscribers indemnify NetRage Networks for any violation of the Service Agreement, law or NetRage Networks policy resulting in loss to NetRage Networks or the bringing of any claim against NetRage Networks by any third party. This means that, if NetRage Networks is sued because of a subscriber's or customer of a subscriber's activity, the subscriber will be responsible for payment of any damages awarded against NetRage Networks, plus costs and reasonable attorney's fees.

We hope this AUP is helpful in clarifying the obligations of Internet users, including NetRage Networks and its subscribers, as responsible members of the Internet. Any complaints about a subscriber's violation of this AUP should be sent to abuse@netrage.net.



End-User License Agreement

This is a legal and binding agreement between you, the Customer, and NetRage Networks. By using, installing or accessing the NetRage Networks website, the Services and certain Products that are offered, as our Customer you agree to all of the terms and conditions of this agreement. If you do not agree to these terms, the Acceptable Use Policy or any other Terms and Conditions posted on the NetRage Networks web site, all services will be discontinued, activation of the account will cease and your account terminated.

END USER LICENSE AGREEMENT

LICENSE GRANT. Subject to the provisions contained herein and payment of applicable fees, NetRage Networks hereby grants to you a non-exclusive, nontransferable, license to use its accompanying proprietary software application products offered on the NetRage Networks web site for your own use. Such Software is protected by the NetRage Networks laws of the United States and international NetRage Networks treaties.

RESTRICTED USE. All rights not expressly granted herein are retained by NetRage Networks and its licensors. Except as stated above, this Agreement does not grant the Customer any intellectual property rights in the Software. Customer shall not rent, lease, transfer or sublicense the Software. Customer shall not under any circumstances nor shall Customer permit a third party to (i) decompile, disassemble, reverse engineer or otherwise attempt to reconstruct or discover the source code of the Software or (ii) prepare derivative of the Software or (iii) remove any product identification, NetRage Networks, trademark or other notice from the Software. Any such copy made by you shall be subject to this Agreement and shall contain all of NetRage Networks' notices regarding NetRage Networks', trademarks and other proprietary rights as contained in the Software originally provided to you.


TITLE. The Software's organization, structure, sequence, logic, and source code are valuable to the Company. Any and all title, ownership rights, and intellectual property rights in and to the Software and Documentation shall remain at any and all times in NetRage Networks and/or its suppliers. Title, ownership rights, and intellectual property rights in and to the content accessed through the Software is the property of the applicable content owner and may be protected by applicable NetRage Networks or other law. This License does not give Customer any rights to such content.

LIMITED WARRANTY. NetRage Networks warrants to the Customer, for a period of ninety (90) days from the date of this agreement, installation of Software, or use of services, whichever is earlier, that it will replace any defective media on which the Software is provided and that the Software, if not modified and if properly installed and used, will substantially conform to the material specifications set forth in the documentation, Such warranties are for the Customer's benefit only and are not transferable. NetRage Networks does not warrant that the Software will operate error free or uninterrupted or will meet your requirements. Except for the express warranties stated in this section, the Software are licensed "as is" and NetRage Networks specifically excludes and disclaims all warranties of merchantability, fitness for a particular purpose, statutory non-infringement of third party intellectual property rights and any warranty that may arise by reason of trade usage, custom or course of dealing and Customer hereby expressly waives any and all such warranties.

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.

LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, OR OTHERWISE, SHALL NetRage Networks OR ITS SUPPLIERS OR RESELLERS BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, OR FOR ANY DAMAGES IN EXCESS OF NetRage Networks' LIST PRICE FOR A LICENSE TO THE SOFTWARE AND DOCUMENTATION, EYEN IF NetRage Networks SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

EXPORT CONTROLS. You may not download, use or otherwise export the Software or any
underlying information or technology except in full compliance with all United States and other applicable laws and regulations. In particular, but without limitation, none of the Software or underlying information or technology may be downloaded, used or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, Haiti, Iraq, Libya, Yugoslavia, North Korea, Iran, Syria or any other country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. By downloading or using the Software, you are agreeing to the foregoing and you are representing and warranting that you are not located in, under the control of, or a national or resident of any such country or on any such list.

TERMINATION. This Agreement is effective until terminated. NetRage Networks may terminate this Agreement immediately if Customer attempts to reverse engineer the Software or otherwise violate any of the restrictive uses as described herein. Otherwise, this Agreement may be terminated by either party for a breach of any of its material terms, provided the non-breaching party provides to the breaching party 30 days written notice describing such breach and offering the breaching party an opportunity to cure. Failure to cure a material breach within the notice period shall result in automatic termination of this Agreement. Should this Agreement be terminated for your material breach, Customer agrees to remove all copies of the Software or any part of the Software from any and all computer storage devices, and destroy the Software and all Documentation. At NetRage Networks' request, Customer or any of Customer's authorized signatory on the account, shall certify in writing to NetRage Networks that all complete and partial copies of the Software and the Documentation have been destroyed and that none remain in Customer's possession or under its control. The provisions of this Agreement except for the Section 1, "License Grant," shall survive.


MISCELLANEOUS. This Agreement represents the complete and exclusive statement of the agreements concerning this license between the parties and supersedes all prior agreements and representations between them. It may be amended only by a writing executed by both parties. THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO TIE TERMS SET FORTH HEREIN, AND NetRage Networks AGREES TO FURNISH THE SOFTWARE AND DOCUMENTATION ONLY UPON THESE TERMS AND NOT THOSE CONTAINED IN YOUR PURCHASE ORDER. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make. It enforceable, and such decision shall not affect the enforceability (i) of such provision under other circumstances or (ii) of the remaining provisions hereof under all circumstances. Headings shall not be considered in interpreting this Agreement. This Agreement shall be governed by and construed under the law of NetRage Networks <state> as such law applies to agreements between NetRage Networks <state> residents entered into and to be performed entirely within NetRage Networks <state>, except as governed by Federal Law. This Agreement will not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is hereby expressly excluded.

U.S. GOVERNMENT RESTRICTED RIGHTS. Use, duplication or disclosure by the Government is subject to restrictions set forth in subparagraphs (a) through (d) of the Commercial Computer-Restricted Rights clause at FAR 52.227-19 when applicable, or in subparagraph (c)(l)(ii) of the Rights in Technical Data and Computer Software clause at DFARS 252.227-7013, and in similar clauses in the NASA FAR Supplement.

Terms of Service

All services provided by NetRage Networks may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any United States federal, state or city law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless NetRage Networks from any claims resulting from the use of service which damages the subscriber or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to NetRage Networks' servers, or any other server on the Internet. Links to such materials are also prohibited.

Examples of unacceptable content or links:

  • pirated software
  • hacker programs or archives
  • Warez sites
  • any site that consumes more than 20% (35% for resellers) of system resources

NOTICE: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND A $50.00 CANCELLATION FEE WILL APPLY. ADDITIONALLY, NetRage Networks WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.

Following are a list of sites that will require more than 20% of our system's resources:

  • multiple domains residing at a single IP address
  • domains with archives or galleries (i.e., .gif, .jpg, .exe, .zip, .tar, etc.)
  • domain accounts offering download files

We are not saying that your web site cannot contain such files; however, if at any time they consume more than 20% of our system's resource (or 35% for resellers), you will be contacted to resolve the problem. NetRage Networks will be the sole arbiter as to what constitutes a violation of this provision.

Traffic Usage
All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and bill $4.00 for each gig of traffic exceeded. This amount is not prorated, meaning that 1mb - 1gb will be treated and billed as the same.

Chat Rooms
We do not allow clients to install their own chat rooms. These tend to be a large drain on system resources and we cannot allow it as an account option.

Background Running Programs
We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred, based on system resources used and operational maintenance required.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Server Abuse
Any attempt to undermine or cause harm to a server or customer of NetRage Networks is strictly prohibited.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion. All sub-networks, distributive hosting sites and dedicated servers of NetRage Networks must adhere to the above policies, with the exception of system resources in respect to dedicated servers.

Billing
By the Account Activation Date of each month, NetRage Networks shall either: (1) debit the client's credit card (when such information has been provided by the client); or (2) deliver, by e-mail or regular mail, an invoice in accordance with the applicable Service Fees for services rendered for the current month. When an invoice is delivered to the client, payment shall be remitted to NetRage Networks by no later than the specified payment due date. NetRage Networks shall be entitled to immediately terminate this agreement for client's failure to make timely payments. You will be provided with an invoice on a monthly basis. All credit cards are billed automatically on a monthly basis. It is the client's responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, we will send an e-mail notification, at which point we will need to be provided with another credit card account number within 24 hours. If we do not receive a response within 24 hours, the account, and all accounts under that account plan, will be suspended.  All prices are subject to change without prior notice.

Service Fees
Certain services carry a set-up fee charged by NetRage Networks to client, which must be paid by client in order to have use of said services. If client terminates this agreement, client shall be responsible for any and all outstanding fees owed to NetRage Networks and agrees to pay any and all fees incurred by client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded. If client has retained the services for one year and has pre-paid NetRage Networks for such services, refunds will be issued for any unused full month of the services, upon client's request. Therefore, if client's account is canceled at any point during the one-year term, client will be entitled to a refund for the months remaining, after notice given by the 25th day of the preceding month.

Account Deactivations
Any account deactivated due to non-payment will require a reactivation fee of $20.00 prior to reactivation.

Cancellation Refunds
We offer a 10 day money back guarantee on shared and reseller hosting accounts. We must receive the request in writing with a signature of the card holder on file in order to process any cancellations. All cancellations can be faxed or mailed to the contact information available on our site. We DO NOT refund partial monthly fees to accounts canceling after their 10-day initial account activation period. Therefore, only pre-paid full monthly fees existing on account will be refunded. No refunds are given on any dedicated servers or setup fees for dedicated servers.

PLEASE NOTE: domain name registration fees WILL NOT be refunded.

Refusal of Service
We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Limitation of Liability
NetRage Networks shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from NetRage Networks' servers going off-line or being unavailable for any reason whatsoever. Furthermore, NetRage Networks shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of NetRage Networks' servers. All damages shall be limited to the immediate termination of service.

Violations
Violations of these Acceptable Use Policies should be referred to support@netrage.net. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

Disclaimer
NetRage Networks cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their site was functioning. Certain services provided by NetRage Networks are resold. Thus, certain equipment, routing, software and programming used by NetRage Networks are not directly owned or written by NetRage Networks. Moreover, NetRage Networks holds no responsibility for the use of our clients' accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as NetRage Networks sees fit.

Account Activation
By activating your account with NetRage Networks, you agree to the above policies and disclaimer. Upon requesting activation of an account, you are required to accept these policies, guidelines and disclaimer, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, no refunds will be given. We will, however, advise you by e-mail or phone prior to taking any action to provide you with an opportunity to correct the problem.

NetRage Networks reserves the right to amend any or all of the above policies, guidelines and disclaimer without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.



Billing Policy

1.0 Account Payment

A. Payment via Credit Card

NetRage Networks, accepts payments via VISA, MasterCard, American Express and Discover. Usage of a credit card indicates authorization to cover all future recurring charges and additional fees with the credit card on file. Credit cards will be charged on the renewal date for the account.

B. Other Payment Methods

NetRage Networks, accepts payments by personal check, company check and money order. All funds must be payable in US dollars. NetRage Networks does not accept international checks in foreign currencies. Payment for services by check must be received prior to renewal dates to avoid interruption of service.

C. Returned Check Fee

In the event that a check is returned, service will be immediately suspended and customer will be sent a suspension e-mail allowing seven (7) days to rectify the situation. If within the seven (7) days the customer fails to pay all service fees, including a $25.00 reactivation fee and a $25.00 returned check fee, customer's account will be permanently cancelled. Such cancellation does not relieve client's obligation for payment under the terms of the hosting agreement. Cancellation includes the removal of all files on the account. In the event of a charge back, NetRage Networks will immediately suspend all services to client until such time as full payment is received in addition to a $25.00 charge back fee and a $25.00 account enable fee.

2.0 Late/Non-Payment

A. Accounts with Non-Usable Credit Cards

Credit cards on file are not usable when any of the following occur:

  1. The card has expired; 
  2. The card declines the charges; 
  3. The card is reported lost or stolen; 
  4. The card is declared invalid. 
  • 5 Days after your account becomes past due you will be sent an email notifying you of the balance
  • After 15 days pass you will receive a pre-suspension notice. (Reminding you of the outstanding balance)
  • On the 17th  day you will receive a final pre-suspension notice (Reminding you again of the outstanding balance)
  • On the 20th day, if your balance has not been brought to zero, the account will be suspended (a $25 reactivation fee will apply and your billing date will be changed to the date payment was received).
  • If payment has still not been made, on the 25th day you will receive an "ACCOUNT DELETION WARNING"
  • On the 28th day your account will be deleted and "ALL FILES WILL BE DELETED FROM OUR SYSTEM"

THIS POLICY PERTAINS TO HOSTING ACCOUNT PAYMENTS, ALL WEB SITE MODIFICATIONS AND ANY SERVICE PERFORMED BY NETRAGE NETWORKS - ON OR OFF SITE - THAT INCUR A FEE.

B. Late Check/Non-Payment

  • 5 Days after your account becomes past due you will be sent an email notifying you of the balance
  • After 15 days pass you will receive a pre-suspension notice. (Reminding you of the outstanding balance)
  • On the 17th  day you will receive a final pre-suspension notice (Reminding you again of the outstanding balance)
  • On the 20th day, if your balance has not been brought to zero, the account will be suspended (a $25 reactivation fee will apply and your billing date will be changed to the date payment was received).
  • If payment has still not been made, on the 25th day you will receive an "ACCOUNT DELETION WARNING"
  • On the 28th day your account will be deleted and "ALL FILES WILL BE DELETED FROM OUR SYSTEM"

3.0 Cancellation Policy

A. Requesting an Account Cancellation

A cancellation will only be accepted if it is done by one of the following methods:

The customer must fax a cancellation request to (610) 647-5581. The request must include the following information:

  • Account Name 
  • Account Password 
  • Cancellation Reason 
  • Signature of Account Owner 

All account cancellations must be received in the above manner at least fifteen (15) days in advance of the date of renewal. Accounts cancelled with less than fifteen (15) days notice shall be cancelled at the end of the next term and shall be charged accordingly.

B. Results of a Cancellation

When a cancellation request is made, NetRage Networks will immediately remove all configuration information as well as all contents of the account on the date of the next renewal of the account. Customer may request immediate cancellation if so desired NetRage Networks will remove all files. This may include unread e-mail left on the server.

4.0 Refund Policy

A. Refunds within the First 30 Days of Service

If an account is cancelled within the first thirty (30) days of service, the customer will receive a full refund of all account fees, including set-up fees, provided:

  1. The account is not a resold account; 
  2. The account has not been suspended for violations of the Acceptable Usage Policy; 

Refunds will be credited to the credit card on file for credit card paying accounts. Accounts paid by check or money order will receive a check via postal mail within sixty (60) days of cancellation.

B. No Refunds Outside of the First 30 Days

NetRage Networks does not offer refunds for services after the initial thirty (30) days of service.

5.0 Keeping Billing Information Current

A. Updating Your Billing Information

You may fax an update to (610) 647-5581. Any fax must include the account name, account password, and signature of the account owner. Personal information may be changed via the customer's Personal Control Panel.

B. Out-of-Date Records

Periodically it may become necessary for NetRage Networks to contact the customer. If the information provided to us is not current, it may lead to the customer failing to receive notices. The customer is solely responsible for keeping all personal and billing information current at all times.

NetRage Networks is not responsible for actions that are taken as a result of a customer's failure to respond to NetRage Networks' notices.

6.0 Invoices and Statements

A. E-mail Invoices/Statements

Customer may request NetRage Networks to send an invoice or account statement via e-mail.  There is no charge for this service.

B. Postal Mail/Fax Invoicing

Customer may request NetRage Networks to send an invoice or statement via postal mail or fax. NetRage Networks will charge customer $5.00 per invoice/statement sent via this manner.

7.0 Taxes

A. Customer Liability

NetRage Networks shall not be liable for any taxes or other fees to be paid in accordance with or related to purchases made from customer. Customer is solely responsible for all taxes and fees of any nature associated with NetRage Networks' products and services.
